The federal election case: Jack Smith’s four counts

The indictment, the immunity ruling, the dismissal, the report and the fight over the investigators

RECORD / AT A GLANCE

Indicted / immunity narrowed the case / dismissed without prejudice / never tried

No court ever ruled on guilt. The indictment and Jack Smith’s report are a prosecutor’s case, never tested by a defense at trial; the dismissal was about the office Trump won, not the evidence. The Arctic Frost phone-records fight is real, and both sides’ accounts of it are partly right.

DOCUMENTED The criminal & civil cases

“Jack Smith said he had enough evidence to convict Trump.”

His final report says that, but for Trump’s election, the office assessed the admissible evidence “was sufficient to obtain and sustain a conviction at trial.” That is a prosecutor’s assessment, not a verdict.

Who says it: Jack Smith, critics of Trump.

PARTLY TRUE The criminal & civil cases

“Jack Smith spied on Republican senators.”

Investigators subpoenaed call logs (who called whom, when, for how long) for eight Republican senators’ personal phones for 4 to 7 January 2021. No call content was obtained. Call logs are not wiretaps; whether the step was justified has not been settled.

Who says it: Sen. Chuck Grassley, Trump allies.

DISPUTED The criminal & civil cases

“Jack Smith timed his court filings to sway the 2024 election.”

His 165-page brief was released on 2 October 2024, weeks before the vote. Smith says he followed the court’s schedule; some legal experts faulted the timing. A Hatch Act inquiry was opened in August 2025; no finding is in the record reviewed here.

Who says it: Sen. Tom Cotton, Trump allies.

FALSE The criminal & civil cases

“The federal election case was dropped because Trump did nothing wrong.”

Smith asked to dismiss it because Justice Department policy bars prosecuting a sitting president, a policy he called “categorical,” not because of the evidence. The judge dismissed it without prejudice. No jury heard it.

Who says it: Trump allies.

FALSE The criminal & civil cases

“Trump was charged for saying the 2020 election was stolen.”

The indictment said he had every right to claim, even falsely, that he won. It charged acts: pressing officials, organizing alternate electors and pressing Pence. Judge Chutkan rejected his free-speech defense; that ruling was never appealed.

Who says it: Trump, his lawyers.
