E. Jean Carroll

A magazine writer said a department-store dressing room became an assault. Years later two federal juries found Trump liable—one for sexual abuse and defamation, one for defamation damages that topped $80 million. Appeals courts affirmed. One judgment was paid. The larger one is still at the Supreme Court’s door.

Between those facts sits a narrow New York rape definition, a judge’s explanation of ordinary English, presidential-immunity arguments, a Westfall Act fight, and a 2026 investigation into outside funding of the lawsuits. This guide follows the documented chain from the 2019 article through late October 2026—and sets each theory against that chain. It does not cover foreign wars. The New York civil-fraud case is a separate file.

The story

The story of the Carroll cases, from the beginning

From a mid-1990s accusation through publication, denials, two trials, two awards, appeals and a pending Supreme Court petition. Every fact is tied to a source. Civil findings, criminal convictions, paid judgments and pending petitions are kept distinct.

Chapter 1

Two juries, two dockets, one unfinished number

This is not a criminal conviction and it is not a gossip file. It is the documented path of E. Jean Carroll’s civil cases against Donald Trump: a mid-1990s accusation, 2019 denials, a battery trial that produced a sexual-abuse finding and $5 million, a damages trial that produced $83.3 million, appeals that affirmed both, payment of about $5.6 million in 2026—and a Supreme Court petition that still shadows the larger award. Chapter 2

A dressing room in the mid-1990s

Carroll’s account is specific: a chance meeting at Bergdorf Goodman, a lingerie joke that stopped being a joke, a locked-in struggle she later called a fight more readily than a rape. [5] She did not call the police. She did tell friends.

Whether you believe her is what a civil jury was later asked—under a preponderance standard, not beyond a reasonable doubt. [1]

Chapter 3

The friends she told

Lisa Birnbach and Carol Martin became the outcry witnesses: people who say they heard the story when it was still raw. [6] [7] Outcry is not video. It is how courts test the “invented decades later” attack.

Chapter 4

A photograph from 1987

Long before the Cut essay, a charity-line photo put Carroll in the same frame as Trump and Ivana Trump. [5] In 2019 Trump said he had never met her. In a 2022 deposition he mistook her for Marla Maples in that picture. [8] The photo does not prove assault. It bruises “never met her.”

Chapter 5

Going public in June 2019

“Hideous Men” and a book with a Swiftian subtitle made the accusation national. [5] Trump answered from the White House and to The Hill: never happened, book sales, politics, “not my type.” [9] [10]

Those words became a lawsuit.

Chapter 6

Carroll I: defamation first

In November 2019 Carroll sued over the 2019 statements—not yet over the 1990s battery, which ordinary limitations had already buried. [11] [12] For years the case was also a Westfall Act fight: could the United States step into Trump’s shoes and end a defamation claim? [13]

Chapter 7

The Adult Survivors Act reopens the clock

New York’s lookback window let expired adult sexual-assault civil claims file for a time. [12] On November 24, 2022, Carroll II added battery and aimed at a fresh Truth Social broadside that called her story a “Hoax.” [14] [15]

Chapter 8

A deposition that would be replayed

October 19, 2022: Trump under oath, insulting Carroll and her lawyer, defending “historically true” star privileges after Access Hollywood prompts, misreading the 1987 photo. [8] Jurors would watch the tape.

Chapter 9

Pattern evidence walks in

Judge Lewis Kaplan allowed the Access Hollywood recording and testimony from Jessica Leeds and Natasha Stoynoff under rules for similar acts in sexual-assault civil cases. [16] [7] Trump’s lawyers called it a pile-on. Appeals later said the package was not reversible error. [17]

Chapter 10

May 9, 2023: the verdict form

Liable for sexual abuse. Liable for defamation. $5 million. Not liable for rape under New York’s then-narrow Penal Law definition on the form. [1] Cable news compressed that into opposite cartoons: “rape verdict” versus “cleared.”

Chapter 11

July 19: Kaplan refuses both cartoons

Denying a new trial, Kaplan wrote that failing the statutory rape definition did not mean failing rape as commonly understood—and that the evidence showed forcible digital penetration. [18] Weeks later he dismissed Trump’s counterclaim with “substantially true” language about ordinary meaning. [19]

Chapter 12

Issue preclusion builds Carroll I’s damages trial

Because the assault finding existed, Kaplan held Trump liable for the false 2019 denials and set January 2024 for damages only. [20] Two dockets, one underlying event.

Chapter 13

January 26, 2024: $83.3 million

A second anonymous jury priced presidential-scale defamation: roughly $18.3 million compensatory and $65 million punitive. [21] [2] Trump posted, testified briefly, walked out of closings. The number became the memory.

Chapter 14

New York changes the statute—prospectively

After the wording fight, the state expanded its rape definition. [22] It does not silently rewrite the 2023 form. It shows how loudly that form echoed.

Chapter 15

The Second Circuit affirms both awards

December 30, 2024: $5 million affirmed. [17] September 8, 2025: $83.3 million affirmed against immunity and excessiveness arguments as presented. [2] En banc bids failed. [23]

Chapter 16

The Supreme Court closes one door

In 2026 the Court denied certiorari and rehearing on the $5 million path. [24] [25] Carroll collected about $5.6 million with interest. [3] [26] One judgment stopped being theoretical.

Reid Hoffman

Chapter 17

The other door is still open

Petition 26-141 asks whether presidential immunity and Westfall substitution should undo or block the $83.3 million judgment for 2019 White House denials. [4] [27] As of late October 2026 the response deadline was October 30. “Must pay $83.3 million” remains unfinished English.

Chapter 18

Money behind the lawyers

A Reid Hoffman–linked nonprofit helped fund Carroll’s counsel—an old discovery fact that became a 2026 investigation story. [28] Chicago’s U.S. Attorney said Carroll herself was not under criminal investigation. [29] Funding is real. Vacatur-by-probe is not a holding.

Chapter 19

What this file refuses to become

It will not swallow the New York civil-fraud case. [30] It will not narrate the Ukraine war because someone used the word “hoax.” [31] It will not call a civil abuse finding a criminal rape conviction—or a nothingburger.

Chapter 20

Path tease — sixteen links to argue with

The mainstream account needs each of these. Theories are scored against them in [[#path|the critical path]]:

1. Bergdorf account — 2. Outcry witnesses — 3. 2019 publication — 4. 2019 denials — 5. Carroll I filed — 6. Westfall fight — 7. Truth Social + deposition — 8. Carroll II under the ASA — 9. Second Circuit affirmances — 14. $5M path closed and paid — 15. $83.3M petition pending — 16. Hoffman-funding probe reported.

Read the steps. Then read the theories that try to break them.

Carroll II and Carroll I judgments plus Second Circuit affirmances.[1][3]

Why it lives

Lives in court opinions, payment of ~$5.6M, and ongoing 26-141 briefing.

If it were true

If true as the courts held, Trump sexually abused Carroll and defamed her; damages follow.

How it squares with the record

A civil jury found sexual abuse and defamation in May 2023. [1]

Kaplan explained the rape-wording issue in July 2023. [5]

A second jury set $83.3M for 2019 defamation; the Second Circuit affirmed both awards. [3] [2]

What holds up Official

Holds for the $5M path after SCOTUS denial; $83.3M holds below pending SCOTUS action.

    How this guide works

    Sources and method

This guide starts from the Carroll II verdict and Kaplan’s July 2023 opinion, the Carroll I damages judgment, the Second Circuit opinions in Nos. 23-793 and 24-644, Supreme Court dockets 25-573 and 26-141, and contemporaneous wire reporting on payment and the May 2026 funding probe.

Grokipedia is used only as a checklist of topics to cover. It is never cited.

Political even-handedness: the same evidentiary standard applies to claims that Trump was ‘convicted of rape,’ that ‘nothing happened,’ and that presidential immunity must erase the 2019 damages. Civil liability, criminal conviction, paid judgments and pending petitions are kept distinct.

This page does not cover the Russia–Ukraine war or other foreign conflicts. The New York Attorney General civil-fraud case is a separate guide and is not absorbed here.

An earlier Trump hub treated Carroll as one short case file. This is the full guide that replaces that format for this topic. It nests under The Trump Files collection.
