The New York civil-fraud case

Inflated values, a half-billion-dollar penalty, and the appeal that erased the penalty

What was inflated

Square footage, restricted land and a lot of optimism, written into documents banks relied on.

Justice Arthur Engoron found that Trump’s annual statements of financial condition overstated his assets by between $812 million and $2.2 billion a year. The best-known example: his Trump Tower triplex was listed at 30,000 square feet, about three times its real size. Other values ignored legal restrictions on land use. [1]

Trump’s defense was that the statements carried disclaimers, banks did their own checks, the loans were repaid and the lenders made money. That is true, and the appeals court took it seriously. But the law the attorney general used does not require proof that a victim lost money. [1][2]

What the appeal did

Five judges, several opinions, one result: no penalty, liability intact.

On 21 August 2025 the Appellate Division threw out the roughly $500 million disgorgement award, with judges calling it excessive. But the court did not agree on much else, and the fraud finding and some business restrictions stayed. [1][2]

Attorney General Letitia James said the ruling still affirmed that Trump broke the law. Trump called it a total victory. In April 2026 he asked the Court of Appeals, the state’s highest court, to dismiss the case altogether, arguing the attorney general had no standing and that sophisticated lenders were not deceived. [3][4][5]

What we can’t tell you. The Court of Appeals had not decided the case as of this edition.
