What the pardon covers

The gun, the taxes and everything else.

The pardon covers offenses against the United States that Hunter “has committed or may have committed or taken part in during the period from January 1, 2014 through December 1, 2024,” including the gun and tax cases. The window opens in the year he joined Burisma’s board. [1]

Weiss noted that the pardon reached uncharged conduct over those eleven years, and his report stopped there: it does not discuss uncharged matters or third parties. [4] A presidential pardon does not cover state crimes and does not erase the record of a conviction. [2][3]

What we can’t tell you. Why the window starts in 2014 was not explained in the pardon.

The broken promise, and Weiss’s reply

“Gratuitous and wrong.”

In June 2024 Biden told ABC he would accept the gun verdict and would not pardon his son. His spokeswoman repeated it after the election. When he reversed himself on 1 December, he said Hunter had been “selectively and unfairly prosecuted” and that “raw politics has infected this process and it led to a miscarriage of justice.” [1][2][3]

Weiss answered in his final report: “This statement is gratuitous and wrong. Other presidents have pardoned family members, but in doing so, none have taken the occasion as an opportunity to malign the public servants at the Department of Justice based solely on false accusations.” He noted that the courts in both cases had rejected Hunter’s selective-prosecution arguments, and wrote: “I prosecuted the two cases against Mr. Biden because he broke the law.” [4]

What we can’t tell you. Weiss is defending his own work; Biden was defending his son.
