Maduro’s capture and the boat strikes

On 2 September 2025 the first missile hit a boat the Pentagon called a drug runner. A second missile killed two men clinging to the wreck. Four months later U.S. forces took Venezuela’s president from Caracas.

The strikes are documented in SOUTHCOM’s own videos. Whether they are war, policing, or crime — and whether Maduro’s capture was an arrest or an invasion — is the fork that splits the country.

Chapter 1

The wreck and the capital

On 2 September 2025 a U.S. missile hit a boat in the Caribbean that the government said was carrying drugs for a cartel it had branded terrorists. A second missile killed two men clinging to what was left. The follow-up strike is not a rumor — the White House later confirmed it [1].

Four months later, before dawn on 3 January 2026, U.S. forces took Nicolás Maduro out of Caracas and flew him toward a New York courtroom that had been waiting since 2020 [2][3].

This guide is the maintained record of that path: designations, missiles, a capital raid, War Powers near-misses, and a trial that has not yet happened. The *mainstream operational story* — the administration’s — is labeled as such. Rival major networks get full cards against the [[#path|critical path]].

Chapter 2

Paper before missiles

Long before the first boat burned, the Southern District of New York had charged Maduro with narco-terrorism tied to something U.S. prosecutors called Cartel de los Soles [3]. The DEA posted rewards [4]. None of that was a conviction. It was a docket.

For years the indictment mostly sat as leverage and rhetoric. What changed in 2025 was not the existence of charges — it was the decision to treat cartels as Foreign Terrorist Organizations and to shoot.

Chapter 3

Terror labels for cartels

On 20 February 2025 the Federal Register published FTO designations for Tren de Aragua and seven other groups [5][6]. In July, OFAC branded Cartel de los Soles a Specially Designated Global Terrorist [7]. In November, State finished the FTO step for Soles [8].

Designation is not an AUMF [9]. It is a powerful U.S. administrative act. The administration then spoke as if the battlefield had opened. Critics answered that drug trafficking is still policing under human-rights law [10]. That fork never closes on this page — it *is* the page.

Chapter 4

September 2

The campaign’s first lethal engagement killed people the government called narco-terrorists and — after a pause that Congress later scrubbed on video — killed two survivors on the wreck [1][11].

Pete Hegseth says he authorized Admiral Frank Bradley, watched the first shot, did not see survivors, and later backed the second [12][13]. Cotton says Bradley denied any “kill them all” order [14]. Smith described shirtless men on a capsized bow [14].

Inside the war frame, shipwrecked people are not targets [15][16]. Outside the war frame, the entire shot sequence is extrajudicial killing [10]. Both critiques can be true in different legal universes; the fight is which universe applies.

Chapter 5

Southern Spear

Through autumn the announcements multiplied — Caribbean, then eastern Pacific [17]. Hegseth named Operation Southern Spear [17]. The Gerald R. Ford strike group moved into the theater [17]. Partners flinched on intelligence sharing [17]. Mexico talked Navy interdiction instead of U.S. bombs [17].

Somewhere in September, Justice Department lawyers wrote an OLC memo the public still has not read [18]. Senators asked for it. FOIA plaintiffs sued. A judge later ordered in camera review. The yardstick’s fifth link remains a sealed envelope.

Chapter 6

December: video, tankers, dock

Early December dragged the Sept 2 tape into classified rooms and the NDAA tied travel money to unedited video and orders [19]. SOUTHCOM’s commander changed amid rumors of dissent [20]. Trump spoke of a complete blockade of sanctioned oil tankers and of closed airspace [21][17]. He also claimed a dock strike inside Venezuela [22].

The public story was no longer only “drugs at sea.” It was coercion against a state.

Chapter 7

Absolute Resolve

War.gov’s account of 3 January is blunt: a joint military and law-enforcement raid, months of rehearsal, more than 150 aircraft, Maduro and Cilia Flores extracted, presented as bringing fugitives to court [2]. Reuters filled in mock houses, a CIA source, cyber blackouts, and contested death tolls [23].

Trump said the United States would run Venezuela for a time and talk oil [2]. Half the UN Security Council heard an armed attack on a capital; others heard the end of a dictatorship [24][25]. Both reactions are part of the record of how the path was *received*.

Chapter 8

War Powers, one vote short

The administration filed a War Powers report after the fact [26][17]. The Senate advanced a brake, then failed 50–50 when the Vice President broke the tie [27]. House efforts died narrowly [28]. Congress did not authorize the campaign. It also did not stop it.

That is not a snarky “gotcha.” It is how the institutional path actually moved — a near-miss that belongs in [[#memory|memory]], not only in a rating badge.

Chapter 9

Courtroom Maduro

In New York, Maduro pleaded not guilty and called himself a kidnapped president and prisoner of war [17]. In October the Justice Department added torture charges — still allegations, with the presumption of innocence printed in the release [29]. Press put trial talk around June 2027 [30].

Winning a custody fight is not the same as finishing a trial. The critical path’s courtroom links remain open.

Chapter 10

The sea does not pause

After Absolute Resolve, the missiles did not stop. Compilers counting official posts reached about seventy-one strikes and roughly 238 killed by early October 2026 — including missing presumed dead [17]. Some later posts call the Coast Guard for survivors instead of firing again [17]. That practice change is a footprint of the December argument. It is not a verdict on September 2.

Chapter 11

Land threats and the dock claim

Before Caracas, the rhetoric climbed ashore. Thanksgiving lines about stopping drugs by land, carrier theater moves, and a presidential claim that the United States knocked out a loading dock inside Venezuela [17][22]. None of that is yet a published execute order for a ground war. It is the runway that regime-change skeptics read forward into Absolute Resolve.

Chapter 12

Allies peel away

Britain and Colombia limited intelligence cooperation; Mexico offered its Navy as an alternative to missiles [17]. The usual counter-narcotics coalition cracked along the legality seam. That cost belongs in the record even if you favor the strikes.

Chapter 13

Named dead, unnamed dead

Most boat decedents remain labels without names in public [17]. One alleged civilian path entered a docket when the Carranza family filed at the IACHR [31]. On the U.S. side, Lance Corporal Oforah became the first known American death tied to Southern Spear — a fall from *Iwo Jima*, still under investigation, not a combat KIA narrative [17].

Chapter 14

Opposition without a throne

María Corina Machado won a Nobel and visited the White House; Trump still declined to install her [32][2]. Delcy Rodríguez held the acting title in Caracas while Washington talked transitional control [2]. Removing Maduro did not automatically seat the opposition’s preferred president.

Chapter 17

How to read the forks

If you take the administration’s path, you need the designations, a NIAC theory, and an answer to the shipwrecked rule on Sept 2. If you take the OHCHR path, you deny the NIAC and treat the campaign as unlawful killings. If you grant the war frame only to prosecute the double-tap, you break a different link. If you cheer or condemn Absolute Resolve, you still owe an account of Article 2(4) and of an indictment that was real.

The [[#theories|seven theory cards]] spell out what each view [[#path|removes and adds]]. [[#memory|Memory phases]] show when the public story itself slid from “drug boats” to “double-tap” to “we run Venezuela.”

Chapter 18

What this page will not do

It will not launder a hostile secondary as if it were the Project Veritas tape — or the War.gov release. Primaries sit on the spine; press is labeled press; compilers are labeled compilers.

It will not build a Ukraine war. It will not cite Grokipedia. It will not pretend yesterday’s confidence never happened when the next release moves a node.

And it will not tell you which camp you must join. It will show why the camps disagree — and which facts would have to change for the critical path to flip.

Administration legal theory after Feb 2025 FTO wave and Sept 2025 OLC memo (text secret).[5][4][2]

Why it lives

Lives in War.gov/SOUTHCOM language (‘narco-terrorists’), WH defenses, and Cotton-style briefings.

If it were true

If true, LOAC (including shipwrecked rules) — not ordinary policing IHRL — is the right frame.

How it squares with the record

FTO designations are real administrative acts. [1][6]

Strikes and Absolute Resolve are openly acknowledged. [3][7]

What holds up Disputed

Holds only if conflict classification and distinction/proportionality can be shown — public evidence on distinction is thin.

Extrajudicial killings outside armed conflict

There is no NIAC with drug cartels; intentional missiles at suspected smugglers are unlawful killings under IHRL and possibly U.S. criminal law.

UN OHCHR, many academic LOAC/IHRL scholars, Sen. Rand Paul, and Democratic WPR sponsors.[1][4][5]

Why it lives

Lives wherever ‘war on cartels’ is heard as slogan rather than conflict classification.

If it were true

If true, each strike needs a policing imminent-threat justification the government has not publicly made.

How it squares with the record

OHCHR explicitly used the extrajudicial-killing frame. [1]

Public dossiers naming decedents are scarce. [2]

What holds up Disputed

Holds strongest when cargo/identity proof stays secret and SAR/capture alternatives exist.

Why it lives

Lives alongside — not instead of — the IHRL critique; it’s the internal LOAC steel-man.

If it were true

If true, individuals who ordered/executed the second shot face war-crime exposure regardless of FTO labels.

Second strike on survivors is documented. [1]

Manual/GC principles bar attacks on shipwrecked. [2][6]

    How this guide works

    Sources and method

This page rebuilds the Trump hub short case Maduro’s capture and the boat strikes as a full AI Files guide.

Spine sources are primaries: DOJ indictments, Federal Register FTO notices, OFAC releases, War.gov / SOUTHCOM announcements, the War Powers Resolution and LOAC texts. Press (Reuters, AP, NBC, CNN, Politico) is labeled as press when it carries confirmations or briefings not yet in a government PDF.

Just Security’s strike timeline is used as a compiler of official announcements and diplomatic reactions — not as an independent body count. Totals (strikes/killed) are the government’s claimed tallies as aggregated by that compiler.

The mainstream critical path is labeled as the administration’s operational story plus the courtroom track. Rival major-network paths (extrajudicial-killing frame; war-crime double-tap; illegal invasion; oil-motive; pretext-to-regime-change) are full theory cards with path.removes / path.adds / mustBeFake.

Ukraine-war material is out of scope. Cross-links point to trump-wars-and-strikes and trump-immigration without rebuilding them. Never Grokipedia.
