Jussie Smollett

A hate-crime report. A hoax finding. A deal. A second prosecution. A vacated conviction.

On January 29, 2019, Jussie Smollett told Chicago police he had been attacked by two men shouting racist and homophobic slurs, pouring a chemical, looping a rope, and invoking MAGA. Within weeks CPD alleged he had paid two brothers to stage it. Charges were dropped, then refiled by a special prosecutor; a jury convicted; Illinois’s highest court later wiped the convictions because the State had broken a bargain — not because it re-found the street facts. This guide keeps those layers separate.

The story

From Streeterville to the Illinois Supreme Court — claim, investigation, deal, trial, reversal.

Chapter 1

A report in Streeterville

On January 29, 2019, Empire actor Jussie Smollett told Chicago police he had been attacked near Lower North Water Street. He described two masked men, racist and homophobic slurs, a chemical poured on him, a rope around his neck, and a line about “MAGA country.” [1] [2]

That combination — race, sexuality, and Trump-era branding — made the claim a national story before investigators had finished the local one.

Chapter 2

The sandwich and the path

Reconstructions later dwelt on ordinary details: a Subway stop, a walk in cold weather, a rope, a reported chemical. [3] None of those details alone proved staging. Together with later witness and payment evidence, they became the furniture of a different story than week-one cable had told.

Chapter 3

Believe him — then ask

In the first days, politicians and celebrities treated Smollett as a hate-crime victim emblematic of the country. Kamala Harris’s solidarity became one of the most replayed examples. [4] [1]

This guide treats that phase as media and political history. Early belief is not the same thing as a forged newsroom memo — and it is also not the same thing as careful epistemology.

Chapter 4

MAGA as accelerant

The alleged slogan pulled Donald Trump into the narrative even before he commented on the later dismissal. [1] For one camp, the detail proved the threat of Trump-era street politics. For another, it sounded like a screenwriter’s idea of a villain. Suspicion is not evidence; it is why the case polarized on contact.

Chapter 5

Brothers, hours, and a check

CPD’s investigation turned when Abimbola and Olabinjo Osundairo — men who knew Smollett — told police they had been paid about $3,500 to stage the assault. [3] [5]

A check and shopping details entered the State’s theory. Smollett’s side offered other explanations and kept denying. The hinge of the factual case is here.

Chapter 6

“Shameful”

On February 21, 2019, Superintendent Eddie Johnson told the city the report was a hoax — staged, he said, to leverage racial pain for career reasons. [6] [3]

The press conference did not convict anyone. It did flip the national frame from solidarity to suspicion in an afternoon.

Chapter 7

Recusal without distance

Cook County State’s Attorney Kim Foxx said she recused after contact connected to Tina Tchen. The case stayed inside the office under Joseph Magats. [7] [1]

Later judges would call that structure an irregularity. Webb would speak of “substantial abuses” without filing crimes against prosecutors. [5] Process scandal and street-fact scandal began to braid.

Chapter 8

Sixteen counts

A grand jury returned a sixteen-count felony disorderly-conduct indictment for false reporting. [7] [2] The vernacular said “hate crime hoax.” The caption said false statements to officers. Keeping those vocabularies distinct is part of reading the case cleanly.

Chapter 9

March 26

In open court, prosecutors nol-prossed the case. Smollett forfeited his $10,000 bond to Chicago and had done community service. He was not required to admit guilt — and afterward he said he was completely innocent. [7]

That afternoon created the legal seed of everything after: bargain, backlash, special prosecutor, second case, and, years later, a Supreme Court opinion about whether the State may break its word.

Chapter 10

Whitewash

Rahm Emanuel and Johnson called the outcome a whitewash; Trump piled on; national coverage treated it as celebrity justice. [2] [7] Judge Michael Toomin later wrote that the disposition shocked officialdom and the community. [7]

Outrage is not a holding. It is why an outside prosecutor became politically possible.

Chapter 11

Webb

Dan Webb was appointed special prosecutor. He criticized how the first case ended and, in 2020, obtained a new six-count indictment. [1] [8]

From Smollett’s point of view, the county had settled and the State was reneging. From the city’s furious point of view, a famous defendant had walked through a side door.

Chapter 12

Trial

At trial the State put on the brothers, payment evidence, and investigative reconstruction. Smollett testified to a real attack. [8] In December 2021 the jury convicted on five of six counts. [2]

That verdict is why so many people still say “hoax proven” — and why the 2024 reversal shocked anyone who thought a jury ended the story forever.

Chapter 13

Sentence

In March 2022 Judge James Linn imposed a jail component, a fine, and roughly $120,000 restitution tied to Chicago’s investigation costs. [8] [2] Smollett was later released pending appeal. The punishment phase cemented the public sense of finality that appeals would undo.

Chapter 14

Affirmed — with a dissent

In December 2023 the Appellate Court affirmed 2–1. Justice Freddrenna Lyle dissented on the meaning of the March 2019 resolution — a complete end, she argued, not a pause. [8] [2]

Dissents sometimes matter later. This one mapped the road to Springfield.

Chapter 15

Due process, not a re-trial

On November 21, 2024, the Illinois Supreme Court reversed. Justice Elizabeth Rochford wrote that a second prosecution after a performed negotiated dismissal violates due process. [7] [9] [10]

Read the negative space: the Court did not hold that the Osundairos lied, that CPD invented the case, or that the jury’s view of the evidence was irrational. It held that the State must keep its bond.

Chapter 16

How television ate the file

Left and right media each found a usable Smollett. One arc was rush-to-believe and awkward correction. The other was hate-crime-hoax synecdoche — sometimes careful to this docket, sometimes inflated into a theory of all bias-crime reports. [11]

Neither cable script replaces the opinions.

Chapter 17

Memory’s three traps

Trap one: week-one certainty. Trap two: treating a jury verdict as immune to process limits. Trap three: hearing “overturned” as “the attack was real” or “the hoax never happened.” [7] [11]

The careful reading is harder to chyron: strong staging evidence fought at trial; a bargain the State later broke; a Supreme Court that enforced the bargain.

Chapter 18

What remains open

Motive embroidery, the full camera canvass, the exact Tchen ask, and civil end-states still generate heat. [3] [2] Those open questions do not erase the critical path. They mark where public confidence still outruns public exhibits.

Chapter 19

Why it still matters

Smollett is a media file because it is a stress test of belief under polarization: victim claims, police pressers, progressive prosecutors, special prosecutors, juries, and supreme courts each moved the story — and each left a slogan that discards the others.

This guide keeps them on one path so rival theories have to say which links they break.

March 26 terms + Toomin/Webb critiques + political shock.[1][2]

Why it lives

ILSC text + trial record summarized on appeal.[1][2]

Why it lives

The reading this guide treats as epistemically careful.

If it were true

Avoids both ‘cleared on facts’ and ‘courts proved the meme forever’ shortcuts.

How it squares with the record

ILSC decides deal/due process, not street re-trial. [1]

Jury convictions happened and were affirmed before that holding. [2]

How this guide works

Sources and method

Primary spine: People v. Smollett opinions (2023 IL App (1st) 220322; 2024 IL 130431), CPD/charging narratives as contemporaneously reported, Smollett’s public denials, and left/right coverage labeled as such.

Keep three layers distinct: (1) what investigators and the jury concluded about staging; (2) what Cook County did in March 2019; (3) what the Illinois Supreme Court held about refiling after a performed agreement. ‘Overturned’ is not ‘hoax disproven.’

Rival paths include factual innocence, staged hoax, celebrity justice, political re-prosecution, media rush-to-believe, and right-wing overgeneralization. Contested motive claims (salary/Empire) are labeled contested.
